Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

Toma-se como objetivo tecer considerações acerca do conceito de autorreflexão e emancipação, entrelaçando-o à pesquisa-ação, por meio do diálogo entre Jürgen Habermas, Theodor W. Adorno, Wilfred Carr e Stephen Kemmis. Os conceitos de autorreflexão e emancipação surgem na Escola de Frankfurt através de Adorno e são incorporados por Habermas, que dá outro sentido a eles. Carr e Kemmis, ao refletirem sobre a pesquisa-ação emancipatória na educação, tomam Habermas como alicerce e constituem o conceito de autorreflexão crítica. A partir das considerações (...) dos autores, o artigo reflete acerca da autorreflexão incorporada na metodologia da pesquisa-ação, principalmente no tocante à formação continuada de profissionais da educação. À luz dos pressupostos habermasianos, defendem-se os conceitos de autorreflexão e emancipação pela via da ação comunicativa, na qual o paradigma da consciência é transposto para o paradigma da linguagem. Compreende-se que para Adorno a autorreflexão está atrelada diretamente à liberdade, ao pensamento crítico e à autonomia, que guiam o indivíduo para a emancipação. Enquanto para Habermas, a autorreflexão vincula-se à linguagem e à comunicação, entre dois ou mais sujeitos, que os guiam para a emancipação. Carr e Kemmis inspirados na espiral cíclica proposta por Lewin e na autorreflexão de Habermas, vão defender a espiral autorreflexiva na pesquisa-ação. Diante disso, entende-se que os problemas da educação têm na racionalidade comunicativa perspectivas de mudanças sólidas, especialmente pela via de processos formativos. (shrink)

O conhecimento tem sido objeto de reflexão e estudo em várias áreas do saber, bem como elemento-chave nas grandes transformações enfrentadas pela humanidade. Assim, a autorreflexão, conforme aponta Jürgen Habermas refere-se a um processo de análise crítica e autorreflexiva realizado por indivíduos e pela sociedade como um todo. A autorreflexão também está associada ao desenvolvimento do entendimento crítico, o que permite que os sujeitos, de modo coletivo avaliem constantemente suas próprias ações e instituições em relação aos padrões de justiça, igualdade (...) e compensação. Em termos mais amplos, a autorreflexão em Habermas está relacionada ao conceito de “espaço público” e à ideia de que uma sociedade saudável e democrática requer um diálogo público aberto e crítico, o que fundamenta a pesquisa-ação. Encontramos na pesquisa-ação uma abordagem que combina a investigação acadêmica com a ação prática para promover mudanças sociais, envolvendo a colaboração entre pesquisadores e membros da comunidade, visando gerar conhecimento relevante e aplicável às questões enfrentadas por estas. Perante o exposto, toma-se como objetivo principal tecer considerações acerca do conceito de autorreflexão para estratégia de produção de dados numa pesquisa-ação crítica. Trata-se de um relato de pesquisa que visa refletir acerca da autorreflexão incorporada na metodologia da pesquisa-ação, principalmente no tocante à formação continuada de profissionais da educação. Nesse contexto, acredita-se que, a partir da autorreflexão crítica tais profissionais possam constituir-se em uma comunidade autocrítica de pesquisadores que investigam suas concepções e ações, possibilitando outros/novos modos de conceber e produzir conhecimentos. We aimed to characterize the age of onset of training, age at menarche, menstrual periodicity, and performance perception during the menstrual cycle and examined the impact of these reproductive variables on body composition, morphology, and body weight satisfaction in Brazilian elite futsal players. The study consisted of 115 female Brazilian elite futsal players from the top national teams. Data were collected during the twentieth Women’s Brazil Futsal Cup. Players were interviewed and self-reported their age of onset of training, age at (...) menarche, menstrual periodicity, and the menstrual period, where they performed best. We also asked for what they considered to be their ideal body weight as well as information related to their training. Subsequently, anthropometric measurements were performed to estimate the body composition and determine morphological characteristics. Fifty-nine players were postmenarche-trained and 52 were premenarche-trained. Eighteen, 65, and 28 were classified as early, normal, and late menarche, respectively. Only 11 and 1 had irregular menstrual cycles and were amenorrheic, respectively. Seventy-three, 23, and 9 reported that their game performance was the best at the follicular phase, menses, and luteal phase of the menstrual cycle, respectively. No associations between the four reproductive-related variables were found. Postmenarche-trained players had significant lower age at menarche and higher percentage body fat. The somatotype profile registered lower ectomorphy rate for the postmenarche-trained participants after controlling for covariates. Early menarche group presented higher sum of six skinfold thickness and endomorphy rate compared to normal and late menarche groups. No differences were found when menstrual periodicity groups and best performance groups were compared, except for higher femur width in the regular menstrual cycle group compared to the irregular one. The association between body weight satisfaction and the four reproductive-related variables were not observed. Premenarche-trained Brazilian elite futsal players had the menarche later than the postmenarche-trained athletes. Most of the participants had menarche age classified as “normal,” presented “regular” menstrual cycles and perceived to perform better during the follicular phase of the menstrual cycle. (shrink)

The ontology behind quantum mechanics has been the subject of endless debate since the theory was formulated some 100 years ago. It has been suggested, at one time or another, that the objects described by the theory may be individual particles, waves, fields, ensembles of particles, observers, and minds, among many other possibilities. I maintain that these disagreements are due in part to a lack of precision in the use of the theory’s various semantic designators. In particular, there is some (...) confusion about the role of representation, reference, and denotation in the theory. In this article, I first analyze the role of the semantic apparatus in physical theories in general and then discuss the corresponding ontological implications for quantum mechanics. Subsequently, I consider the extension of the theory to quantum fields and then analyze the semantic changes of the designators with their ontological consequences. In addition to the classical arguments to rule out a particle ontology in the case of non-relativistic quantum field theory, I show how the existence of black holes makes the proposal of a particle ontology in general spacetimes unfeasible. I conclude by proposing a provisional pluralistic ontology of fields and spacetime and discussing some prospects for possible future ontological economies. (shrink)

Research teams have used extra-uterine systems to support premature fetal lambs and to bring them to maturation in a way not previously possible. The researchers have called attention to possible implications of these systems for sustaining premature human fetuses in a similar way. Some commentators have pointed out that perfecting these systems for human fetuses might alter a standard expectation in abortion practices: that the termination of a pregnancy also entails the death of the fetus. With Biobags, it might be (...) possible, some argue, that no woman has the right to expect that outcome if the technology is able to sustain fetal lifeafteran abortion. In order to protect the expectation that the termination of a pregnancy always entails the death of the fetus, Elizabeth Romanis has argued that fetuses sustained in Biobags have a status different than otherwise ‘born’ children. In support of that view, she argues that these ‘gestatelings’ are incapable of independent life. This argument involves a misunderstanding of the gestational support involved, as well as a misapprehension of neonatology practice. Here, we argue that any human fetus sustained in a Biobag would be as ‘independent’ as any other premature infant, and just as ‘born’. Neonatologists would seem to have certain presumptive moral responsibilities toward any human fetus gestating in a Biobag. It remains a separate question whether the perfection and widespread application of Biobags for premature human beings would or should alter the expectation that ending a pregnancy also entails fetal death. This textbook presents the basics of philosophy that are necessary for the student and researcher in science in order to better understand scientific work. The approach is not historical but formative: tools for semantical analysis, ontology of science, epistemology, and scientific ethics are presented in a formal and direct way. The book has two parts: one with the general theory and a second part with application to some problems such as the interpretation of quantum mechanics, the nature of mathematics, and (...) the ontology of spacetime. The book addresses questions such as "What is meaning?", "What is truth?", "What are truth criteria in science?", "What is a theory?", "What is a model?" "What is a datum?", "What is information?", "What does it mean to understand something?", "What is space?", "What is time?", "How are these concepts articulated in science?" "What are values?" "What are the limits of science?", and many more. The philosophical views presented are "scientific" in the sense that they are informed by current science, they are relevant for scientific research, and the method adopted uses the hypothetical-deductive approach that is characteristic of science. The results and conclusions, as any scientific conclusion, are open to revision in the light of future advances. Hence, this philosophical approach opposes to dogmatic philosophy. Supported by end-of-chapter summaries and a list of special symbols used, the material will be of interest for students and researchers in both science and philosophy. Methodological tools for doing philosophy that take into account the historical context of the phenomenon under consideration are arguably better suited for examining questions of race and gender than acontextual or ahistorical methodological tools. Accordingly, Rebecca Tuvel’s “defense” of so-called transracialism arguably veers off track to the extent that it relies on acontextual and ahistorical tools. While Tuvel argues, largely relying on such tools, that so-called transracialism is both metaphysically possible and ethically permissible, from a perspective that factors in context (...) and history, so-called transracialism is arguably neither. Nonetheless, Tuvel’s ethical call to the effect that an individual right to racial self-definition should be acknowledged has its appeal. However, the lesson to be learned from the Tuvel affair arguably has less to do with the metaphysical or ethical status of so-called transracialism than with changes that arguably need to be made in the way mainstream/analytic professional philosophy goes about its business, particularly with regard to non-ideal topics like race and gender. The police’s use of facial recognition technologies allows them to verify identification in real-time by mapping facial features into indicators that can be compared with other data stored in its database or in online social networks. Advances in facial recognition technologies have changed law enforcement agencies’ operations, improving their ability to identify suspects, investigate crimes, and deter criminal behavior. Most applications are used in tracking and identifying potential terrorists, searching for abducted and missing persons, and security surveillance at airports, national (...) borders, and large public gatherings. However, for facial recognition technologies to fulfill their potential, they must not only be adopted by the police, but the public must also support their routine use. Using a secondary data analysis of a public opinion survey conducted by the Pew Research Center among a representative sample of US residents (N = 5307), we investigated the factors associated with the public`s expectations about the positive and negative outcomes of the police’s adoption of facial recognition technologies. Our results show that public attitudes to FRT are balanced, indicating awareness of the public for potential advantages, but also disadvantages of police adoption of FRT. Privacy considerations and familiarity with the technology were found to be critical for the explanation of public attitudes expressing both positive and negative expectations from the police adoption of facial recognition technology. Our study contributes to the understanding of the factors associated with public attitudes police’s use of facial recognition technologies. (shrink)

O Transtorno do Espectro Autista (TEA) é caracterizado pela presença de déficits persistentes na comunicação e interação social, além de padrões restritos e repetitivos de comportamentos, interesses e atividades. Como forma de viabilizar a inclusão das crianças autistas no ambiente escolar, a orientação dos professores que atuam com este público é de suma importância. O objetivo do estudo é apresentar a experiência de orientação feita para os professores que lecionam para alunos autistas, acompanhados pelo Núcleo de Atenção ao TEA, da (...) cidade de Monte Alto-SP, no período de junho de 2022 a junho de 2023. Trata-se de um estudo descritivo, do tipo relato de experiência, embasado na ciência ABA (Análise do Comportamento Aplicada) e relacionado às vivências com os professores em orientações, realizadas mensalmente. Como resultado, observou-se a dificuldade dos docentes em acolher estes alunos, direcionar atividades, lidar com comportamentos disruptivos e no manejo das atividades de vida diária. Discute-se a importância de uma ferramenta de apoio para proporcionar aos docentes maior respaldo teórico à prática com alunos autistas, para contribuir na inclusão, aprendizagem e socialização no ambiente escolar. Esta experiência ampliou as vivências sobre a perspectiva do professor na inclusão escolar de crianças com TEA, lançando luz sobre a necessidade de formação teórica e instrumentalização dos docentes, considerando as particularidades de neurodesenvolvimento e comportamento desta população e contribuindo para a maior eficácia da assistência educacional inclusiva. There are communities in which disadvantaged groups experience severe inequality. For instance, poor and indigent families face many difficulties accessing their social rights. Their condition is largely the consequence of the wrong choices of those in power, either historical or more recent choices. The lack of opportunities of these deprived citizens is due to state omissions. In such communities, it is not unusual for homeless members of these particular groups to occupy abandoned lands and build their shelters there. However, almost (...) everywhere, these actions constitute a crime. The typical response to this situation is prosecution and punishment. In this paper, I will defend the occupation of public places as a consequence of the failure of governments to solve the problem of housing, and I will argue that we must distinguish a social claim from a crime and avoid the use of criminal law in these “occupation cases”. I will also argue that our right—as a community—to blame and punish these “squatters” is eroded by the fact that we perpetrated their situation of injustice. (shrink)

The Kalam Cosmological Argument is perhaps the most solid and widely discussed argument for a caused creation of the universe. The usual objections to the argument mainly focus on the second premise. In this paper we discuss the dependency of the first premise on the topological structure of the space-time manifold adopted for the underlying cosmological model. It is shown that in chronology-violating space-times the first premise can also be violated. The chronology-violation, in turn, requires a massive violation of the (...) so-called energy conditions which might have observational effects that are briefly discussed here. Hence, astronomical observations could be relevant for the validity of the metaphysical argument. In this sense, it is possible to talk of “observational theology”. (shrink)

Closed time-like curves (CTCs) naturally appear in a variety of chronology-violating space{times. In these space{times, the principle of self-consistency demands a harmony between local and global a airs that excludes grandfather-like paradoxes. However, selfexisting objects trapped in CTCs are not seemingly avoided by the standard interpretation of this principle, usually constrained to a dynamical framework. In this letter we discuss whether we are committed to accept an ontology with self-existing objects if CTCs actually occur in the universe. I present a condensed exposé of systemic materialism, a synthesis of materialism and systemism originally proposed by Mario Bunge. Matter is identified with mutability of propertied particulars, and a concrete or material system is defined as an object with composition, structure, mechanism, and environment. I review different aspects of this ontology, and discuss some of its implications for epistemology, ethics, and aesthetics. I also try to identify some problems of this view and offer some ways to overcome the difficulties. A distinction is introduced between itemized and non-itemized plural predication. It is argued that a full-fledged system of plural logic is not necessary in order to account for the validity of inferences concerning itemized collective predication. Instead, it is shown how this type of inferences can be adequately dealt with in a first-order logic system, after small modifications on the standard treatment. The proposed system, unlike plural logic, has the advantage of preserving completeness. And as a result, inferences such as (...) ‘Dick and Tony emptied the bottle, hence Tony and Dick emptied the bottle’ are shown to be first-order. (shrink)

This article discusses Benjamin's interpretation of Baudelaire's poetry as a key to reading modernity. Understanding the ambiguities between novelty and archaism, typical of the time, is only possible thanks to the poet’s gesture of privileging radical contingency. On the one hand, the violence of unwanted encounters amid the crowd does not allow for reflection; on the other, its productive dimension makes contingency speakable. The poet’s verses will make possible the encounter of the now of experience with the available past in (...) terms of expectation: explanatory images are produced from the singularity of language. In this paper I examine the three known objections to metalinguistic semantic theory of proper names: the objection of generalization, the objection of circularity, and the objection arising from Kripke’s modal argument. I’m trying to demonstrate that these objections are not conclusive as refutation or rejection of metalinguistic theory. I argue that this is a not a theory of reference but rather of the meaning or semantic value of proper names. Thus, the semantic value of a proper name “N” is (...) “The bearer of ‘N’.” In this approach the significance of this proper name unifies all the possibilities for its referential use and allow us to defend that the name itself is an expression of language, despite arguments to the contrary. El neoplatonismo da un giro significativo cuando Jámblico integra a su doctrina una perspectiva mística basada en los _Oráculos Caldeos_. Esta recopilación de fragmentos, que se remonta al zoroastrismo babilónico, surgió en la civilización helenística y ganó relevancia como textos herméticos entre los filósofos a partir del siglo II. Para Jámblico, la preocupación neoplatónica sobre la posibilidad de un retorno al Uno se aborda no tanto a través de una filosofía puramente abstracta, sino mediante una sabiduría filosófica iluminada por la (...) práctica teúrgica. Jámblico afirma la legitimidad de los ritos detallados en estos textos hieráticos, sosteniendo que fueron inspirados por Dios mismo a Juliano. Siriano y Proclo desempeñan un papel crucial en la preservación y transmisión de este legado. Al heredar las enseñanzas de Jámblico, no solo consideraron este enfoque teúrgico como un elemento cuasi refundacional del neoplatonismo, sino que también introdujeron sus propias contribuciones a su desarrollo. Además, actuaron como los intermediarios a través de los cuales estas doctrinas llegaron al autor del _Corpus Dionysiacum_. En este punto, Dionisio Areopagita entra en escena. Él revitaliza el concepto de teúrgia, aunque –como este trabajo tratará de demostrar– su intento de integrar el neoplatonismo con el cristianismo refleja un retorno a la interpretación original de la teúrgia por parte de Jámblico. Las doctrinas de Dionisio proporcionan una base sólida para que él sostenga que los ritos cristianos instituidos por Jesús –siendo realizados por Dios mismo, en y a través de su propia persona– son doblemente verdaderos. Por lo tanto, estos ritos conducen ciertamente a la _theosis_, el único medio para lograr la unión del alma con el Dios cristiano. (shrink)

In Metaphysics A.4, Aristotle provides crucial information about fundamental aspects of the chemistry and microphysics of the atomic theory of Leucippus and Democritus of Abdera. Besides the plenum and the void, which he identifies as the elements of the atomic theory, he presents what he himself names as differences. These fundamental differences are named so because they ought to be responsible for the emergence of all other differences in the physical world, and especially the ones that hit our senses. Aristotle (...) provides a list of three differences both in what is recognized as autochthonous terminology from Leucippus and Democritus, and in a translation to terms apparently more intelligible to Aristotelian listeners. Among those differences there is one in particular that is harder to comprehend than the other ones: rhysmos. Aristotle’s translation of rhysmos into schēma has led most interpreters to acknowledge that it referred solely to atoms individually, while the other two differences would refer to relations between atoms. In this paper, I want to propose an interpretation in which rhysmos actually refers to several aspects of the chemistry and microphysics of the atomic theory. (shrink)

Psychiatrists such as Michael Fitzgerald, Christopher Gillberg and Yoshiki Ishisaka diagnosed Ludwig Wittgenstein posthumously with Autism Spectrum Disorder (ASD). Taking this diagnosis into account, the present paper discusses how Wittgenstein's philosophy reveals his cognitive difficulties. Wittgenstein's grammatical inquiries are particularly investigated here, highlighting his misunderstandings concerning the use of words – specially, his misunderstandings concerning analogies, which he tended to interpret literally.

ABSTRACTContrary to what some critics of epistemic democracy claim, the association between democracy and truth does not necessarily make the former inhospitable to conflict, contestation, and pluralism. With the help of John Stuart Mill and William James, truth can be interpreted so as to make it compatible with a democratic politics that appreciates conflict and dissent. In some circumstances, truth claims are politically relevant and should become the object of democratic deliberation.

Black holes are extremely relativistic objects. Physical processes around them occur in a regime where the gravitational field is extremely intense. Under such conditions, our representations of space, time, gravity, and thermodynamics are pushed to their limits. In such a situation philosophical issues naturally arise. In this chapter I review some philosophical questions related to black holes. In particular, the relevance of black holes for the metaphysical dispute between presentists and eternalists, the origin of the second law of thermadynamics and (...) its relation to black holes, the problem of information, black holes and hypercomputing, the nature of determinsim, and the breakdown of predictability in black hole space-times. I maintain that black hole physics can be used to illuminate some important problems in the border between science and philosophy, either epistemology and ontology. (shrink)

Knowledge representation is a central issue in a number of areas, but few attempts are usually made to bridge different approaches accross different fields. As a contribution in this direction, in this paper I focus on one such approach, the theory of conceptual spaces developed within cognitive science, and explore its potential applications in the fields of philosophy of science and formal epistemology. My case-study is provided by the theory of truthlikeness, construed as closeness to “the whole truth” about a (...) given domain, as described in the underlying language. I show how modeling propositions and their relations within a conceptual space has interesting implications for two issues in truthlikeness theory: the so called problem of language dependence, and that of measure sensitivity. I conclude by pointing at some open issues arising from the application of conceptual spaces to the analysis of philosophical problems. (shrink)

En este artículo nos proponemos analizar la demostración de la existencia de Dios dada por Kant en dos de sus obras precríticas, en las cuales se postula la necesidad funcional del _fundamento_ material como enlace entre la realidad propositiva (determinaciones de realidad) y la _posibilidad_ de los particulares. Este fundamento material aparece como condición necesaria para el contenido del pensamiento, o la determinación de los conceptos. Como foco de análisis tenemos las siguientes dos obras: la _Nueva dilucidación sobre los primeros (...) principios del conocimiento metafísico_ de 1755, y _El único argumento posible para una demostración de la existencia de Dios_, de 1763. Nos proponemos señalar la continuidad conceptual y argumentativa entre estas obras en lo que respecta a las determinaciones de realidad. A su vez, nos interesa detenernos en dos conceptos que refieren a Dios, que son centrales en el argumento ontológico kantiano, y que serán retomados por el propio Kant en la _Crítica de la razón pura_; estos conceptos son _omnitudo realitatis_ (totalidad de la realidad) y _die höchste Realität_ (la suma realidad). La influencia del Al-Andalus, no solo dejó su impronta en el mundo Mediterráneo, sino que además se extendió en el urbanismo y en las formas culturales en América, con posterioridad a los acontecimientos de la Conquista. Las edificaciones en la Nueva España y en Quito (Ecuador) fueron, en parte, depositarias de los cruces e influencias de la tradición mudéjar en Hispanoamérica, como un producto de aquella continuidad territorial e histórica. En este contexto, las Órdenes Mendicantes encarnaron estos nuevos aportes a (...) través de la arquitectura religiosa. Ello brindó una fisonomía renovada a las portadas, espacios internos y techumbres de los templos y conventos, principalmente. (shrink)
